Recently in Columbus, Ohio a 42 year old firefighter was arrested for exposing himself to a woman who was sunbathing in the park. If the story was that simple I would agree that flashing yourself in public is wrong and that this man should be arrested. However, the story is not that simple. It is a story of entrapment and bad legislation. Supposedly in this Ohio park, it is legal for women to be topless. However, it is illegal for anyone to show anything below the waist. The police were standing by and video tapping this topless woman sunbathing when a man approached her. She invited the man to sit down and flirted with him. She had high cut shorts on without her top. At one point she put her legs on the man’s shoulders. After a few minutes of flirting she asked the man if she could see his ‘private parts’. He obliged and was quickly confronted by the Columbus Police Department that arrested him and charged him with a misdemeanor. The Police department report that the women is not affiliated with the police department in anyway. This creates an interesting question, is it legal for the police to video tape an unknowing topless female subject? Is it legal to use this woman as bait to catch a man showing his ‘private parts?’ The fine the man received is only $250, one year’s probation and ordered to stay away from the park. But now his name is all over the national news (I will not use it), he has legal fees to cover and is currently assigned to a desk job while the fire department conducts an investigation. This man is a fire fighter! We need every first responder we can get! We can not let a skilled, experienced firefighter remain at the desk when we need him. The Columbus police department stated that this type of police sting helps to catch ‘perverts.’ Is it perverted for a man to respond to a half naked woman’s advances? I am more concerned about the men that would not respond to these advances! The problem in Columbus is multifold. The laws are unclear. If I was visiting Columbus Ohio, I would not know the law that naked breasts are OK, naked penis’ is not. Laws are unclear. Public nudity is either fully legal or its illegal. When we make guidelines on what is decent we are in trouble. What will be next; women can be topless in the park only if her boobs are D size of bigger and she is under 40 years old? Next is that Columbus is obviously spending too much money on a police department that is not being used properly. With the amount of deaths on America’s highways from Drinking and Driving, the rise in crystal meth, and the overall rise in drug use, the best this police department can do is arrest a fire fighter for showing his privates? This situation is so embarrassing, not only for the poor fire fighter that got caught, but for Columbus, Ohio. Fix the legal system in your city so public laws are clear and understandable.
